New York State Supreme Court Justice Joseph C. Teresi has found Dell guilty of false advertising and fraud.
Last year, the Attorney General of New York instigated a lawsuit against Dell for practices like long hold times, repeated call transfers, and disconnects for customers waiting for phone support — all of which make it harder to cash in on promises of (and paid-for) technical support.
The case arose after hundreds of complaints about Dell and its finance arm Dell Financial Services.
According to the ruling, the company engaged in abusive debt collection practices, misled consumers about the financing terms for which they had qualified and failed to provide consumers with promised rebates.
New York Attorney General Andrew Cuomo has asked consumers to register their complaints at a special website so that damages can be assessed. He said:
For too long at Dell the promise of customer service was a bait and switch that left thousands of people paying for essentially no service at all. We have won an important victory that will force Dell to live up to its responsibilities.
In its 26 page judgement court also found that Dell often failed to provide onsite repairs for customers who bought contracts for such support and often blamed software when hardware was actually the problem. The court laid out plans for investigating how many people have been affected as a way to determine restitution.
A Dell spokesman said the company disagrees with the ruling and feels that it was based on a small number of customers. It may appeal the ruling which will be decided after looking at judgement thoroughly.
