eBay has won the lawsuit filed by Jewelry firm Tiffany & Co, accusing it of failing to keep users from selling forged items on the site, after US judge ruled in favour of them.
The ruling came as a sigh of relief for eBay which lost a similar case in France last month when a judge imposed $30,000 fine over sale of counterfeit goods.
In the current case a US district Judge Richard Sullivan, in New York ruled that the company cannot be held liable for the sale of counterfeit goods by its users as it adequately addressed the specific claims of counterfeiting, and that eBay should not be required to take additional steps to stop the counterfeit sales.
eBay released the following statement:
The ruling confirms that eBay acted reasonably and has adequate procedures in place to effectively address counterfeiting. While today’s decision is a victory for consumer choice, it is a shame that so much effort has been wasted when Tiffany could have worked with eBay to more effectively fight counterfeits.
